CNH is a leading equipment and services company engaged in the design, production, marketing, sale, and financing of agricultural and construction equipment. As a global company, we are subject to the different data privacy laws that apply in the markets in which we operate. Whether you are a dealer, distributor, end-use customer (or prospective customer), supplier or other stakeholder, we are committed to ensuring that your Personal Data is handled securely and in compliance with applicable laws and regulations. This Privacy Statement explains, among other things, how and why we collect, use or disclose your Personal Data.

This Privacy Statement does not apply to information collected:

  • For employment-related Personal Data from employees, job applicants, contractors or similar individuals, which are addressed by other privacy notices;

Your Personal Data may be shared with other affiliates of CNH, which act either as controllers or as processors and are formally bound to process your Personal Data solely for the purposes agreed or they commit to.
Third-party service providers
Third-party service providers assist us in providing information, products, or services to you, in conducting and managing our business, or in managing and improving our products or services. When we share information to such third-party service providers, it is subject to appropriate contractual restrictions and security measures.
Authorized third-party dealers and distributors
We may share your Personal Data to authorized third-party dealers and distributors, most of which are independently owned and operated businesses, to distribute the Products and Services and to provide support to you.  These third-party businesses frequently hold and maintain the most direct relationship and contact with end-use customers (and prospective customers) of our products and services.
Other third parties
We may have to disclose your Personal Data with regulatory authorities in circumstances that include, but are not limited to fulfilling our reporting obligation, responding to requests from them, when it is necessary to establish, exercise, or defend legal claims, when you request us to do so if this does not constitute a violation of our or others' rights, or when it is necessary or appropriate to prevent physical harm or material financial losses to us or others. When we are legally compelled to disclose your Personal Data, we will only provide the smallest amount of such data permissible when responding to a request for disclosure.

6. INTERNATIONAL DATA TRANSFERS

Your Personal Data may be processed and accessed from countries other than your country, and where different data privacy laws apply. When Personal Data is transferred internationally, we ensure that the laws in force in the recipient's country provide adequate protection. This includes, by way of example, participation in a data privacy framework granted by an adequacy decision or the adoption of appropriate contractual measures to guarantee the adequate protection of Personal Data. In some countries, obtaining consent allows us to transfer Personal Data to other countries. 7. INFORMATION SECURITY

Your Personal Data may be processed both automatically and manually. We try to protect all Personal Data using measures that are reasonable and proportional to the risks you would be exposed to in case your Personal Data is leaked, lost, and used for unauthorized purposes. Per our internal security policies, procedures and applicable law, these safeguards include physical, administrative, technical, and organizational measures. If a security incident occurs and affects your Personal Data, we will take reasonable actions to avoid or mitigate possible harm to you. When provided for by applicable laws, this may include a notification to you or competent authorities when the incident is likely to result in serious harm.

8. DATA RETENTION

Your Personal Data will be kept, in accordance with applicable laws and regulations, for a period not exceeding the time necessary to achieve the purposes for which it was collected. The criteria for determining the period of retention of Personal Data consider the period of permitted processing (for all the relevant purposes), applicable regulations affecting minimum or maximum retention (if any), limitation of rights, and the legal basis for processing.

We may retain any or all categories of Data when your information is subject to one of the following exceptions:

  • When stored in our backup and disaster recovery systems. Your Data will be deleted when the backup media your Data is stored on expires or when our disaster recovery systems are updated.
  • When necessary for us to exercise or defend legal claims.
  • When necessary to comply with a legal obligation.

When we have no ongoing legitimate business need to process your Personal Data, we may delete or anonymize it.

Should you submit a request to exercise any of your rights, we may ask for additional information to confirm your identity. We will also retain information concerning your request, including your identification and contact details, for as long as necessary to pursue specific objectives, including handling any objections to how we handled your request or any additional requests, internal evaluation of the process, and demonstrating that we handled your request correctly in the event of audits or reviews by competent authorities. Once a request is submitted, you should receive confirmation of receipt from us. If you do not receive such an acknowledgment within a reasonably short time, please contact us immediately. If your request can be met, it will be handled without undue delay and within the timeframe required by applicable data privacy laws. Otherwise, we will promptly inform you about why the request cannot be met.

10. MINOR’S PRIVACY

Our products, services, website and applications are not directed to children or adolescents, and we do not knowingly collect or further process Personal Data of children under 18 years of age.
